What is the difference between Chapter 7 and Chapter 13?
This is a common question, and there are a lot of Bankruptcy attorneys that focus on Chapter 7 because they are less complicated and can get the petitioner a discharge of debt quickly. A Chapter 13 bankruptcy is more complex, however you can discharge or restructure your debt in such a way that it may be more advantageous to you to file a Chapter 13. Under Chapter 13, you can potentially discharge your unsecured second mortgage on your home, including home equity lines of credit, and subsequently strip off the lien - leaving your property unencumbered by that unsecured junior mortgage lien when your Chapter 13 bankruptcy is finally discharged. Also, if you are hoping to modify your home loan, you need to talk to an attorney that can help you either restructure the debt you have or analyze your assets in order to help you qualify for a home loan modification.
